An application for approval of a corporate agreement known as the Echuca Security Enterprise Agreement 2011 has been submitted. The Commission was concerned that the agreement would include charges and penalties in the rates of pay. In the event of the dismissal of a worker, that worker shall be entitled to the payment of both the annual leave and the annual leave charge if he is authorised to do so. This right is based on a provision of annual leave in the event of termination in the Fair Work Act 2009. The provision states that if a worker is dismissed and has an unused annual leave, he must receive what he would have paid if he had taken that period of annual leave. The Full Bench decided that the following 11 principles apply to the application of boot to a collective agreement: the Fair Work Act requires that payment for annual leave be made at the worker`s base rate as applied at the time of taking leave.  A charged rate including annual leave requires workers to fund all periods removed from work, which excludes the NES annual leave provisions. In the event of an obligation to pay the annual leave charge, the additional entitlement must be paid for all periods of annual leave taken. In most cases, the annual discharge charge in the event of termination is paid out of the accumulated annual leave balances. The charge should not be paid for other types of leave, such as personal leave and long-term leave. A leave of 17.5% per year is a feature of most modern rewards. The leave burden means that a worker who takes annual leave is entitled to this additional payment in addition to his or her basic salary. An agreement may include heavy rates of pay that compensate for the benefits provided by the modern distinction. In cases where an allowance is included in the hourly wage of the agreement, this rate must be increased in order to compensate for the abolition of bonuses that would no longer apply.
